Important notes on these tools

Below are some questions about the tools and plans we have, you may also find the FAQ section helpful. Specific tool usage notes are below.

* 1. Specific tool conditions applicable to all plans
  • With the exception of the Roboalp platform - these plans only cover licenses. There are additional costs for setup/support of these tools, should you wish the Agency to do this. Alternatively you are free to set these tools up yourself.
  • Endorsal and Trafft tools do not include optional SMS costs. These can be added as and when needed.
  • New Oaks professional chatbot monthly fee covers all features in the Professional plan - but not complimentary token usage. An Ai key must be setup with the clients card to ensure PAYG usage. Limits can be set on consumption.
  • In the majority of cases, these tools and plans are completely independent of Retainer Bundle tools - see the box on differences explained.
**⚡ 2. MAX plan conditions
  • 2.1 All conditions applicable in clause 1 above are applicable to this plan also.
  • 2.2 The ⚡MAX plan cost can increase at any time for new subscribers due to the new platforms being added or cost increases to existing platforms which are not in the Agency's control. Existing subscribers will continue with their original cost unless external platform licensing changes require an increase in costs. Subscribers who cancel their ⚡MAX plan cannot be guaranteed their original price should they wish to resubscribe in the future.
  • 2.3 The 'version' (Vx.x) of the plan determines what platforms are available for your subscription. New platforms will be added with priority for legacy subscribers. These platforms will be added as complimentary where possible for MAX plan subscribers only. Where this is not possible they may be added to 'new versions' (i.e V1.1) which existing subscribers will have the option to upgrade to.
  • A new tool may not be available for an existing MAX plan because either or both of the following factors are in play:
  • Considerable additional cost (which means the MAX plan bundle price increases above your current payment)
  • Limited availability.
  • There is no obligation for a client to change their current plan if that plans works for them.
  • 2.4 If the number of platforms offered in the ⚡ MAX plan bundle reduces for reasons outside the Agency control, the cost will not decrease until it is clear that the RRP monthly value of the tools is less than the current plan price. In this scenario the price may decrease or the plan may be discontinued and customers will switch to a ⊞ BUILD plan.

Use of the tool licenses inside these plans follows terms in Section 6 of Schedule C and/or Section 8 in Schedule E, which will be incorporated into your contract by reference.

*Some 'Web & Marketing' tools such as security monitoring tools may need to be setup and/or managed by the Agency but this is the exception, not the rule.

Is there ever crossover between tools?

In rare cases the same tool/perk may be offered on both Retainer bundles and Web/Marketing Plans.

In such cases those on the Web & Marketing Upgraded MAX plan and active Retainer clients would have priority access.

Tools FAQ

The below FAQ apply to both the tools within Web & Marketing monthly plans and Retainer Bundle plans.

How do you pick these platforms?
  • We do the heavy lifting of research, testing and communication when it comes to platform selection.
  • Many platforms we utilise ourselves so we have 'skin in the game' and would not recommend a platform we wouldn't be happy to use ourselves.
  • We only recommend platforms that we feel provide efficient and reliable functionality and are managed by financially savvy teams for longevity.
How can you offer these tools at such low prices?
  • The key terms are 'early investment', 'negotiated or early deals' and 'limited licenses'.
  • Through considerable research/testing and a keen eye on developing Sass offerings, we vet then purchase/negotiate licenses with platforms we trust either directly and/or via partner deals.
  • As we invest in these platforms in earlier stages we secure multiple (but limited) licenses for significantly cut prices, sometimes even limited complimentary licenses as part of our commitment, beta testing, feedback and investment.
  • As these platforms grow and develp their prices rise, but in most cases our original arrangements are honoured and the discounted prices can be provided for clients.
  • As with all investments there is risk involved in the sense of no software is guaranteed to be in business indefinitely. See Schedule C Section 6 and Schedule E Section 8
How long will I be able to use the tools?
  • Unless there is disruption to our original agreement or the platform is purchased/merged into a different provider, you can continue to use the tools as long as you are subscribed to a Web & Marketing plan and/or you are an active retainer customer.
  • If you have a discounted price on a Web & Marketing monthly plan as a retainer customer, your discount will be applicable as long as you are both an active retainer customer and subscribed to the plan. If you cancel either plan, the discount price will no longer apply.
  • We make informed decisions for ourselves and clients in good faith, but cannot guarantee any platform will remain in business indefinitely. See Section 6 of Legal Schedule C for full conditions.
What happens if I unsubscribe to a Web & Marketing Plan or terminate my retainer?
  • If you unsubscribe or downgrade your plan, the relevant licenses will be removed and made available to new subscribers.
  • You will have the option of resubscribing in the future to the same or similar plan. However as license availability is limited and plan structure can change, it's not guaranteed you will be able to resubscribe to a plan identical to your old plan in either structure or cost.

Use of the tool licenses inside these plans follows the legal terms in Section 6 in Schedule C and/or Section 8 in Schedule E, which will be incorporated into your contract by reference.
